Failure to provide requested information may limit, delay, restrict, or prevent consultation services.

12. Accuracy & Completeness of Information

Healthcare recommendations depend substantially upon the accuracy of information voluntarily supplied by users.

Accordingly, you represent and warrant that:

  • Information supplied is accurate.
  • Information supplied is complete.
  • Information supplied is truthful.
  • Information supplied is current.
  • You will not intentionally conceal relevant medical information.
  • You will promptly update material changes affecting your health condition.

The Company shall not be responsible for decisions, recommendations, or outcomes arising from false, incomplete, inaccurate, misleading, or outdated information supplied by users.

Users shall not modify, manipulate, reproduce, distribute, or use any electronic prescription for any unlawful purpose.

22. Prescription Validity, Review & Renewal

Unless expressly stated otherwise, any prescription or recommendation shall remain valid only for the consultation in respect of which it was issued or for such period as may be specified therein.

Prescription renewal shall not be automatic.

Before renewing any recommendation or prescription, the Company may require:

Accordingly:

  • Certain conditions cannot be adequately assessed without physical examination.
  • Photographs, videos, or verbal descriptions may not accurately reflect the user’s actual medical condition.
  • Diagnostic testing may be necessary before meaningful recommendations can be made.
  • Technical interruptions may affect communication quality.
  • Emergency conditions cannot be adequately managed through remote consultation.

Where appropriate, the Company may recommend in-person examination, specialist consultation, diagnostic investigations, or emergency medical evaluation.

Remote consultation should not be relied upon as a substitute for emergency medical care or comprehensive clinical examination where such services are reasonably required.

26. No Warranty

To the fullest extent permitted under applicable law, all consultation services, wellness guidance, educational materials, healthcare information, prescriptions (where legally permissible), product recommendations, electronic communications, digital content, and related services made available by Herbal Samrat International Co. are provided on an “as available” and “as applicable” basis.

Except where warranties cannot lawfully be excluded, Herbal Samrat International Co. does not represent or warrant that:

  • Consultation services will always be available without interruption.
  • Every consultation request will be accepted.
  • Every consultation will result in a prescription or recommendation.
  • Every health concern can be appropriately evaluated through remote consultation.
  • Every product will be suitable for every individual.

  • Third-party communication platforms, marketplaces, payment gateways, telecommunications services, or internet services will remain continuously available.
  • Electronic communications will always be delivered without delay.

Nothing contained in this Policy shall exclude, restrict, or limit any statutory rights that cannot lawfully be excluded under applicable law.

27. Limitation of Liability

Nothing in this Policy excludes liability which cannot lawfully be excluded under applicable law.

28. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Herbal Samrat International Co., its directors, officers, employees, consultants, healthcare professionals, contractors, affiliates, licensors, distributors, authorized representatives, and service providers from and against any claims, liabilities, losses, damages, costs, expenses, or reasonable legal fees arising directly or indirectly from:

The Company’s obligations shall remain suspended only for the duration reasonably necessary to overcome such circumstances.

30. Changes to this Policy

Nothing contained herein shall prevent compliance with mandatory legal obligations applicable in any jurisdiction where such obligations cannot lawfully be excluded.

33. Jurisdiction

  • Other officially authorized electronic communication channels

Such communications may include:

If you do not agree with any provision of this Policy, you must immediately discontinue the use of consultation services.

37. Official Communication Verification

Users are solely responsible for ensuring that consultations, payments, product purchases, prescriptions, recommendations, and communications are conducted only through official communication channels authorized by Herbal Samrat International Co.

The Company shall not be liable for losses arising from interactions with fake social media accounts, unauthorized sellers, counterfeit websites, impersonators, or any person falsely claiming association with the Company.

38. Counterfeit Products Disclaimer

41. Severability

If any provision of this Policy is determined by a court or competent authority to be invalid, unlawful, or unenforceable, such provision shall be deemed severed only to the extent necessary.

The remaining provisions shall continue in full force and effect to the fullest extent permitted by applicable law.

42. Survival

Any provisions of this Policy which, by their nature, are intended to survive termination or completion of consultation services—including, but not limited to, confidentiality, privacy, intellectual property, fraud prevention, electronic records, limitation of liability, indemnification, governing law, jurisdiction, and dispute-related provisions—shall continue to remain effective to the extent permitted by applicable law.
