Cancellation Policy

Welcome to Herbal Samrat International Co. (“Herbal Samrat“, “Company“, “We“, “Us” or “Our“).

This Cancellation Policy (“Policy“) explains the terms, conditions, procedures, limitations, rights, responsibilities, and legal framework governing the cancellation of product orders, consultations, appointments, healthcare-related services (where available), subscriptions (if introduced in the future), and other eligible services offered by Herbal Samrat International Co.

Our objective is to maintain transparency, provide fair customer service, ensure operational efficiency, comply with applicable laws, and protect the legitimate commercial and legal interests of both our customers and the Company.

Because Herbal Samrat International Co. operates in the field of male sexual wellness and offers Ayurvedic, Homeopathic, Allopathic, nutraceutical, wellness, and other legally permitted healthcare-related products and services, certain orders may require consultation, prescription review (where applicable), inventory allocation, regulatory verification, quality inspection, packaging, dispatch preparation, logistics coordination, or other operational activities before shipment.

Accordingly, cancellation eligibility may vary depending upon the stage of order processing and the specific circumstances of each transaction.

This Policy forms an integral part of the contractual relationship between the customer and Herbal Samrat International Co.

2. Purpose of this Policy

This Policy has been prepared to:

  • Explain when and how customers may request cancellation of eligible orders or services.
  • Describe the Company’s cancellation procedures.
  • Clarify customer responsibilities during the cancellation process.
  • Protect inventory, logistics, consultation resources, and operational efficiency.
  • Prevent fraudulent, abusive, or dishonest cancellation requests.

Nothing contained in this Policy is intended to exclude, restrict, or waive any consumer rights that cannot legally be excluded under applicable law.

3. Scope of this Policy

This Policy applies to all eligible orders, consultations, healthcare guidance, and services provided directly or indirectly by Herbal Samrat International Co. through any officially authorized platform, including but not limited to:

  • Customer portal(s);
  • Mobile applications;
  • WhatsApp Business;
  • Telephone consultations;
  • Email communications;
  • SMS communications;
  • Video consultations (where available);
  • Facebook;
  • Instagram;
  • X (formerly Twitter);
  • YouTube;
  • LinkedIn;
  • Telegram;
  • Online marketplaces including Amazon, Flipkart, Meesho, Shopsy, and similar marketplaces;
  • Authorized distributors;
  • Authorized dealers;
  • Franchise partners;
  • Authorized healthcare representatives;
  • Customer support representatives;
  • Authorized sales representatives;
  • Offline consultation centres (where available); and
  • Any future website, mobile application, marketplace, communication technology, digital platform, artificial intelligence platform, or other sales or communication channel officially authorized by Herbal Samrat International Co.

Where products are purchased through independent third-party marketplaces, the operational policies of those marketplaces may also apply in addition to this Policy.

4. Domestic & International Applicability

This Policy applies to customers located both within India and outside India.

Certain provisions relating to customs, international logistics, cross-border shipping, export regulations, import restrictions, international payment processing, governmental approvals, and destination-country laws may apply only to international transactions.

Where mandatory consumer protection laws of a particular jurisdiction provide customers with rights that cannot legally be excluded, those mandatory rights shall prevail only to the extent required by applicable law.

5. Definitions

For the purposes of this Policy:

“Company” means Herbal Samrat International Co.

“Customer” means any individual, organization, institution, distributor, reseller, dealer, business entity, or other person purchasing products or services from the Company.

“Order” means any confirmed request to purchase one or more products or services offered by the Company.

“Cancellation” means the termination of an eligible order, consultation, appointment, or service before its completion, subject to this Policy.

“Consultation” means any consultation, healthcare guidance, wellness guidance, educational interaction, customer support, or healthcare-related communication offered by or on behalf of Herbal Samrat International Co.

“Prescription” means any recommendation, prescription, treatment suggestion, healthcare advice, or related documentation provided by an authorized healthcare professional, where legally applicable.

“Dispatch” means the stage at which an order has been handed over to a courier, logistics provider, postal authority, freight company, or any authorized shipping partner for transportation.

“Working Day” means any day on which the Company’s operational offices are ordinarily open for business, excluding officially declared public holidays unless otherwise specified.

6. General Principles

All cancellation requests shall be assessed fairly, reasonably, and in accordance with:

  • Applicable laws;
  • Regulatory requirements;
  • Operational feasibility;
  • Payment status;
  • Consultation status;
  • Inventory allocation;
  • Packaging status;
  • Dispatch status;
  • Export or customs requirements (where applicable);
  • Supporting documentation; and
  • The specific facts of each individual case.

Submission of a cancellation request does not automatically result in approval.

Every request shall be independently reviewed before an appropriate decision is made.

Customers should submit cancellation requests only through the Company’s officially authorized communication channels.

The Company shall not be responsible for cancellation requests submitted through unauthorized persons, unofficial websites, fake social media accounts, unofficial messaging groups, or any communication channel not expressly authorized by Herbal Samrat International Co.

8. Customer’s Right to Request Cancellation

Subject to this Policy, applicable laws, and the specific circumstances of each transaction, customers may request cancellation of eligible product orders, consultations, appointments, or services.

A cancellation request shall not be deemed accepted merely because it has been submitted. Every request shall be reviewed individually by Herbal Samrat International Co. after considering operational status, payment status, consultation status (where applicable), dispatch status, inventory allocation, regulatory requirements, and other relevant factors.

The Company reserves the right to request additional information before making a final decision.

9. Cancellation Before Payment

Where an order has been placed but payment has not yet been successfully received or verified:

  • Customers may generally cancel the order without cancellation charges, provided that no consultation, product reservation, or special processing has commenced.
  • The Company may automatically cancel unpaid or abandoned orders after a reasonable period without prior notice.
  • Products shall not ordinarily remain reserved indefinitely for unpaid orders.

10. Cancellation After Payment but Before Order Processing

If payment has been successfully received and verified, but the Company has not yet materially commenced order processing, customers may request cancellation.

If approved:

  • Eligible refunds shall ordinarily be processed in accordance with this Policy, the Payment Policy, and the Return, Refund & Replacement Policy.
  • The Company may deduct only those charges that are lawfully recoverable and have actually been incurred, such as non-refundable payment gateway charges or banking charges, where applicable.

11. Cancellation After Order Processing Has Commenced

Once an order has entered one or more operational stages, including but not limited to:

  • Consultation review (where applicable);
  • Prescription verification;
  • Inventory allocation;
  • Quality inspection;
  • Product reservation;
  • Packaging;
  • Label generation;
  • Invoice generation;
  • Regulatory compliance checks;
  • Dispatch preparation; or
  • Logistics booking,

cancellation may no longer be immediately possible.

Depending upon the stage of processing, the Company may:

  • Approve the cancellation;
  • Decline the cancellation;
  • Offer an alternative resolution;
  • Process the request as a return after delivery, where applicable; or
  • Deduct reasonable operational expenses where permitted by applicable law.

Each request shall be assessed individually.

12. Cancellation Before Dispatch

Customers are encouraged to submit cancellation requests as early as possible.

If the request is received before the shipment has been handed over to the courier or logistics partner, the Company shall make reasonable efforts to stop dispatch, where operationally feasible.

However, due to automated warehouse systems, courier integrations, and operational workflows, the Company cannot guarantee that every cancellation request received shortly before dispatch can be successfully processed.

13. Cancellation After Dispatch

Once an order has been handed over to a courier, logistics provider, postal authority, freight carrier, or any other authorized shipping partner, the order shall ordinarily be treated as dispatched.

At this stage:

  • Cancellation may no longer be available.
  • Customers may instead become eligible for return, refund, or replacement, subject to the Company’s Return, Refund & Replacement Policy.
  • Any outward shipping charges, return shipping charges, customs charges, handling costs, payment processing costs, or other reasonable expenses already incurred may be deducted where legally permissible.

14. Consultation Cancellation

Where consultation services are available, customers should notify the Company as early as reasonably possible if they wish to cancel a scheduled consultation.

Subject to applicable law:

  • Consultations cancelled before commencement may generally be cancelled without consultation charges.
  • Once a consultation has commenced or has been substantially completed, cancellation or refund may not be available in respect of the professional services already rendered.

15. Prescription-Based & Consultation-Based Orders

Certain products or treatment recommendations may be provided following consultation or professional assessment, where applicable.

Where:

  • A prescription has already been reviewed;
  • Professional consultation has been completed;
  • Healthcare guidance has already been provided;
  • Customized recommendations have been prepared; or
  • Professional services have already been substantially performed,

the Company may restrict or refuse cancellation of the related order or consultation, subject to applicable law.

Nothing in this section limits any mandatory consumer rights available under applicable law.

16. Marketplace Orders

Orders placed through third-party marketplaces including, but not limited to, Amazon, Flipkart, Meesho, Shopsy, or similar platforms may also be governed by the cancellation procedures, timelines, technical limitations, and operational rules of the respective marketplace.

Where mandatory marketplace rules apply to a particular transaction, those rules shall apply in addition to this Policy.

17. International Order Cancellation

International orders may require export documentation, customs processing, international logistics arrangements, regulatory compliance, foreign carrier acceptance, and destination-country procedures.

Accordingly:

  • Cancellation requests should be submitted immediately after the customer decides not to proceed.
  • Once export formalities or international dispatch have commenced, cancellation may no longer be possible.
  • Refund eligibility shall be determined in accordance with this Policy, the Return, Refund & Replacement Policy, applicable laws, and the actual stage of shipment.

Customers remain responsible for ensuring the accuracy of shipping information and compliance with the import laws of the destination country.

18. Customer Responsibilities During Cancellation

Customers requesting cancellation agree to:

  • Submit cancellation requests through the Company’s official communication channels only;
  • Provide complete, accurate, and truthful information;
  • Cooperate with reasonable verification procedures;
  • Respond promptly to requests for additional information;
  • Avoid duplicate cancellation requests submitted through multiple channels;
  • Refrain from making false, misleading, or fraudulent statements; and
  • Comply with all applicable Company policies.

Failure to provide necessary information may delay or prevent processing of the cancellation request.

19. No Automatic Right to Cancellation

The submission of a cancellation request does not create an automatic or unconditional right to cancellation.

Every request shall be evaluated individually based upon:

  • Payment status;
  • Consultation status;
  • Prescription status (where applicable);
  • Inventory allocation;
  • Operational progress;
  • Dispatch status;
  • Applicable legal obligations;
  • Regulatory requirements;
  • Supporting documentation; and
  • The specific facts and circumstances of the transaction.

The Company reserves the right to approve, partially approve, reject, or request additional information before reaching a final decision, while acting reasonably, fairly, and in accordance with applicable law.

20. Company’s Right to Cancel Orders

Herbal Samrat International Co. reserves the right to cancel, suspend, refuse, or place on hold any order, consultation, appointment, or service request where such action is reasonably necessary to:

  • Comply with applicable laws or regulatory requirements;
  • Protect the Company’s operational, commercial, financial, or legal interests;
  • Prevent fraud or misuse of the Company’s services;
  • Protect customer safety;
  • Maintain inventory integrity;
  • Ensure responsible healthcare practices; or
  • Address circumstances beyond the Company’s reasonable control.

Where reasonably practicable, the Company shall make reasonable efforts to notify the customer of such cancellation.

21. Payment Verification Failure

The Company may cancel or suspend an order where:

  • Payment authorization fails;
  • The payment gateway declines the transaction;
  • Payment remains pending beyond a reasonable period;
  • A bank transfer cannot be verified;
  • The payment is reversed or disputed before dispatch;
  • Duplicate or suspicious payment activity is detected;
  • Payment information appears inconsistent; or
  • Any other payment-related issue prevents secure completion of the transaction.

Orders shall ordinarily not proceed to dispatch until successful payment verification has been completed, except where Cash on Delivery (COD) has been accepted by the Company.

22. Cash on Delivery (COD) Verification

Cash on Delivery services are offered only where operationally feasible.

Before dispatching a COD order, the Company may conduct reasonable verification procedures.

The Company may cancel a COD order where:

  • The delivery location is not serviceable;
  • Verification attempts remain unsuccessful;
  • Previous COD orders have been repeatedly refused by the customer;
  • Fraud prevention systems identify elevated risk;
  • Delivery restrictions exist; or
  • The Company reasonably believes fulfilment may not be commercially or operationally appropriate.

Availability of COD may vary by location, product category, order value, courier availability, or business requirements.

23. Stock Unavailability

Although Herbal Samrat International Co. uses reasonable efforts to maintain accurate inventory records, products may occasionally become unavailable due to:

  • Inventory shortages;
  • Manufacturing delays;
  • Regulatory restrictions;
  • Product discontinuation;
  • Supplier limitations;
  • Quality control decisions;
  • Unexpected demand; or
  • Other unforeseen operational circumstances.

Where this occurs, the Company may:

  • Cancel the affected order;
  • Offer an equivalent product (with customer consent where appropriate);
  • Partially fulfil the order;
  • Issue an appropriate refund; or
  • Provide another reasonable resolution.

24. Pricing, Technical & System Errors

The Company reserves the right to cancel an order where a genuine pricing, technical, administrative, or system error has materially affected the transaction.

Examples include:

  • Incorrect product pricing;
  • Incorrect promotional pricing;
  • Website software malfunction;
  • Inventory synchronization failure;
  • Incorrect tax calculation;
  • Human error;
  • Product listing mistakes;
  • Technical failures; or
  • Similar operational errors.

Where practicable, customers may be offered the opportunity to place a fresh order using the corrected information.

25. Fraud Prevention & Risk Assessment

To protect genuine customers and maintain the integrity of its business operations, Herbal Samrat International Co. may cancel, suspend, or refuse any order where there are reasonable grounds to suspect:

  • Identity fraud;
  • Payment fraud;
  • Unauthorized use of payment instruments;
  • False customer information;
  • Fake delivery addresses;
  • Abuse of promotional offers;
  • Bulk purchasing for unauthorized resale;
  • Repeated policy abuse;
  • Multiple suspicious customer accounts;
  • Forged documents;
  • Chargeback abuse; or
  • Any activity reasonably indicating fraudulent or unlawful conduct.

The Company may request additional verification before deciding whether to process or cancel such orders.

26. Identity & Order Verification

Before accepting, processing, dispatching, or continuing an order, the Company may request reasonable information necessary to verify:

  • Customer identity;
  • Billing information;
  • Delivery address;
  • Contact details;
  • Payment information;
  • Prescription details (where applicable);
  • Consultation records (where applicable); or
  • Any other information reasonably necessary for secure order processing.

Failure to provide requested information within a reasonable period may result in cancellation of the order.

27. Prescription, Consultation & Healthcare Review

Where an order involves consultation, healthcare guidance, prescription review, or any healthcare-related assessment, the Company may decline or cancel the order if:

  • Required information is incomplete;
  • Consultation cannot be completed;
  • A healthcare professional considers the requested product unsuitable based on available information;
  • Legal or regulatory restrictions apply; or
  • Fulfilment would not be appropriate in the circumstances.

Such decisions are intended to support responsible healthcare practices and compliance with applicable laws.

28. Customized, Special Procurement & Personalized Orders

Where products are specially procured, customized, specially packaged, personalized, or prepared specifically for an individual customer, cancellation may not be possible once procurement, manufacturing, customization, or preparation has commenced.

Any refund, if applicable, shall be determined after considering:

  • The stage of preparation;
  • Costs already incurred;
  • Commercial feasibility; and
  • Applicable law.

29. Business, Bulk & Institutional Orders

Orders placed by:

  • Businesses;
  • Corporate customers;
  • Hospitals;
  • Clinics;
  • Healthcare institutions;
  • Authorized distributors;
  • Franchise partners;
  • Dealers; or
  • Customers placing bulk purchase orders,

may be subject to separate cancellation terms agreed between the parties.

Where no separate written agreement exists, this Policy shall apply together with any mutually agreed commercial terms.

30. Future Services & Business Expansion

If Herbal Samrat International Co. introduces additional products or services in the future, including but not limited to:

  • Subscription services;
  • Membership programmes;
  • Digital healthcare services;
  • Mobile application services;
  • International distribution programmes;
  • Telemedicine features (where legally permitted);
  • Wellness plans; or
  • Other recurring services,

the Company may publish supplementary cancellation terms applicable to those specific services.

Such supplementary terms shall form part of this Policy where relevant.

31. Promotional Offers, Discounts & Coupon Orders

Orders placed using promotional offers, discount coupons, referral benefits, loyalty rewards, cashback schemes, festive campaigns, or other promotional programmes may be subject to additional cancellation conditions.

Where an order is cancelled:

  • Promotional benefits may automatically become invalid.
  • Coupon codes may not be reissued unless expressly approved by the Company.
  • Cashback, reward points, loyalty credits, gift vouchers, or promotional benefits may be withdrawn or adjusted.
  • Refunds, if applicable, shall be calculated based on the actual amount paid by the customer after applying eligible discounts and deductions.

The Company reserves the right to modify, suspend, or withdraw promotional offers at any time, subject to applicable law.

32. Duplicate, Mistaken or Accidental Orders

If multiple identical orders are placed accidentally, customers should notify the Company immediately through its official communication channels.

Where operationally feasible, the Company may cancel duplicate orders before dispatch.

However, if duplicate orders have already entered processing, packaging, or dispatch stages, cancellation shall remain subject to this Policy and the actual operational status of each order.

33. High-Risk Transactions

To safeguard customers and protect the integrity of its business operations, Herbal Samrat International Co. may subject certain transactions to enhanced review where they appear to involve elevated risk.

Examples include:

  • Unusually high-value purchases;
  • Multiple orders placed within a short period;
  • Inconsistent customer information;
  • Repeated payment failures;
  • Suspicious payment behaviour;
  • Unusual ordering patterns;
  • High-risk delivery locations; or
  • Any other circumstances reasonably indicating increased operational or fraud risk.

During such review, the Company may temporarily suspend, verify, or cancel the order where reasonably necessary.

34. Export Compliance & International Trade

International orders are subject to applicable export control laws, customs regulations, sanctions, import restrictions, and other legal requirements of India and the destination country.

The Company may cancel or refuse an international order where:

  • Export authorization cannot be obtained;
  • Import restrictions apply;
  • Customs clearance appears unlikely;
  • Applicable trade laws prohibit the transaction; or
  • Fulfilment would expose the Company to legal or regulatory risk.

Customers remain solely responsible for ensuring that the ordered products may lawfully be imported into their country.

35. Restricted Countries & Sanctioned Jurisdictions

Herbal Samrat International Co. reserves the right to refuse or cancel orders originating from, destined for, or otherwise connected with countries, territories, individuals, or entities that are subject to applicable sanctions, trade restrictions, governmental prohibitions, or other legal limitations.

The Company shall not be required to process any transaction that may violate applicable laws or regulatory obligations.

36. Government Directions, Product Recall & Regulatory Actions

The Company may cancel, suspend, or refuse any order where reasonably necessary due to:

  • Government directions;
  • Court orders;
  • Regulatory investigations;
  • Product recalls;
  • Licensing issues;
  • Safety concerns;
  • Public health measures;
  • Regulatory compliance obligations; or
  • Any similar legal or governmental requirement.

Where appropriate, customers shall be informed and suitable remedies shall be considered in accordance with applicable law.

37. Marketplace & Third-Party Platform Orders

Orders placed through online marketplaces or third-party sales platforms may additionally be governed by the operational policies of those respective platforms.

Where marketplace rules conflict with this Policy, mandatory marketplace procedures shall apply only to the extent required for processing that specific transaction, while all remaining matters shall continue to be governed by this Policy and applicable law.

38. Reservation of Company’s Rights

Nothing contained in this Policy shall restrict the Company’s right to:

  • Protect its legitimate commercial interests;
  • Prevent fraud, abuse, or misuse;
  • Verify customer identity;
  • Request additional documentation;
  • Refuse transactions prohibited by law;
  • Suspend suspicious activities;
  • Enforce its contractual rights;
  • Comply with judicial, governmental, or regulatory directions; or
  • Take any other lawful action reasonably necessary to protect its business operations, customers, employees, partners, intellectual property, reputation, or legal interests.

The exercise of these rights shall be carried out reasonably, in good faith, and in accordance with applicable law.

39. No Waiver

Any delay or failure by Herbal Samrat International Co. to exercise any right, remedy, discretion, or provision under this Policy shall not constitute a waiver of that right.

Any waiver shall be effective only if made expressly in writing by an authorized representative of the Company.

40. Interpretation

Headings and section titles contained in this Policy are provided solely for convenience and shall not affect the interpretation of any provision.

Where any ambiguity arises, the provisions of this Policy shall be interpreted in a manner consistent with applicable law, the overall purpose of this Policy, and the legitimate rights and obligations of both the customer and the Company.

41. Refunds Following Approved Cancellation

Where a cancellation request is approved by Herbal Samrat International Co., any applicable refund shall be processed in accordance with:

  • This Cancellation Policy;
  • The Company’s Payment Policy;
  • The Return, Refund & Replacement Policy;
  • The Terms & Conditions;
  • Applicable laws; and
  • The specific circumstances of the transaction.

Approval of a cancellation request does not automatically entitle the customer to a full refund.

The amount refundable, if any, shall depend upon factors including:

  • The stage of order processing;
  • Whether consultation or professional services have already been provided;
  • Whether the order has been packed or dispatched;
  • Operational and administrative costs already incurred;
  • Payment gateway or banking charges that are non-refundable;
  • Shipping, logistics, customs, duties, taxes, or governmental charges;
  • Any deductions permitted under applicable law; and
  • The provisions of this Policy and other applicable Company policies.

42. Refund Processing Timeline

Where a refund is approved:

  • Refund processing shall ordinarily be initiated within a reasonable period after successful verification.
  • The actual time required for crediting the refund depends upon the customer’s bank, card issuer, payment gateway, UPI provider, financial institution, or other payment service provider.
  • Herbal Samrat International Co. shall not be responsible for delays occurring after the refund has been successfully initiated.

For Cash on Delivery (COD) orders, approved refunds shall ordinarily be processed through bank transfer or another lawful payment method determined by the Company after successful verification of the customer’s identity and banking details.

43. Cancellation Charges

Where legally permissible, the Company may deduct or recover reasonable costs actually incurred in connection with an approved cancellation, including but not limited to:

  • Payment gateway charges;
  • Banking charges;
  • Currency conversion charges;
  • Packaging costs;
  • Shipping and logistics expenses;
  • Return freight charges;
  • Customs duties and governmental fees (where applicable);
  • Administrative expenses; and
  • Other actual operational costs directly attributable to the cancelled order.

No deduction shall be made where prohibited by applicable law.

44. Customer Responsibilities

Customers requesting cancellation agree to:

  • Provide complete, accurate, and truthful information;
  • Cooperate with reasonable verification procedures;
  • Respond promptly to Company communications;
  • Use only the Company’s official communication channels;
  • Refrain from providing false, misleading, or fraudulent information; and
  • Comply with this Policy and all other applicable Company policies.

Failure to cooperate may delay or prevent processing of the cancellation request.

45. Force Majeure

Herbal Samrat International Co. shall not be liable for any delay, suspension, inability to process a cancellation, or failure to perform its obligations where such circumstances arise due to events beyond the Company’s reasonable control, including but not limited to:

  • Natural disasters;
  • Floods;
  • Earthquakes;
  • Fires;
  • Pandemics or epidemics;
  • War;
  • Civil unrest;
  • Government actions;
  • Court orders;
  • Regulatory restrictions;
  • Export or import controls;
  • Transportation disruptions;
  • Labour strikes;
  • Cybersecurity incidents;
  • Power or communication failures; or
  • Any other force majeure event.

The Company shall make reasonable efforts to minimise the impact of such events where commercially practicable.

46. Limitation of Liability

To the fullest extent permitted by applicable law, Herbal Samrat International Co. shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the cancellation of any order, consultation, or service.

Where liability is established under applicable law, the Company’s total liability shall ordinarily be limited to the amount actually paid by the customer for the affected order, unless a greater remedy is required by mandatory law.

Nothing in this Policy excludes or limits any liability that cannot legally be excluded.

47. Amendments to this Policy

Herbal Samrat International Co. reserves the right to amend, revise, replace, update, or modify this Cancellation Policy at any time to reflect changes in:
